why do we test for TDB_ERR_NESTING?

It seems we have this test for TDB_ERR_NESTING, but we do not actually
use the result as far as I can see.

Can anybody remember the history here, or give me a reason why we should
not just remove the test?  It seems we simply rely on the TDB version
number, and use the internal TDB if not new enough (rather than testing
for particular features).
