Non-GPL drivers that are derived works of the kernel aren't able to be 
distributed. 

The GPL allows users to link non GPL drivers against the kernel which is how 
ATI/Nvidia have attempted to, or succeeded in, circumventing the GPL.

Yes.

Yes. I know this is the case with Gentoo as well.
