To the rest of the list:
I do apologise to anyone who was offended by my reaction. These are the
reasons why I did eract so strongly:
a) The message was in my opinion relevant, and on topic but lacked the
necessary part to make it comply with the Act. This is a technicality
and I do realise that many of you disagree with me.
b) In my opinion, any complaint against this message would NOT have
resulted in any legal action. However, any formal complaint against a
person results in a letter to said person or thier parebnt organisation,
informing them that a complaint has been lodged and is being assessed.
Such a notification, with a few exceptions is required by law, and not
at the discretion of the enforcing agency.
c) In most cases that would not land anyone in trouble, but some
organisations (and I simply don't know which ones they are) are very
very risk averse and such a notification may result in unpleasent
consequences for the person, and pehaps hamer their career. I do not like
seeing people put in a position where the processes required by law may
do more harm than good.
d) I expected Novell to have updated thier employees about the
requirements for of the Spam Act, but thats not really relevant to the
problem.
I do hope this makes it clear why I was so harsh. I do apologise for
that.
