[Samba] [Bulk] differences between 3.5.6-86.el6_1.4 and 3.5.11-79.fc14 and "file is in-use"

I can see I might have not been obvious in my first email, 
to rectify obscureness

3.5.6-86.el6_1.4, selinux=disabled => Java app does NOT complain
3.5.11-79.fc14, selinux=permissive => Java COMPLAINS

same configs for both Sambas
