[Samba] files and folder locking

Hi, i'm running samba 3.0.14-r1 on a gentoo ReiserFS,
we have discovered a strange situation:

user A opens /folder1/folder2/file1 and keep it opened (Word, Excel, 
anything )
user B can move/rename the folder holding the file, but the deletion of 
the folder/file is denyed

opened files appears in the locking tdb and there's no corruption message

is this a misconfiguration ??? i haven't anything defined about locking 
in my smb.conf
