Not true, I didn't say to assume or negotiate anything; I suggested that the option be there. Always do a binary transfer, except if the user explicitly says "ASCII" which would mean that he wants to transfer an ASCII file between a Unix & dos machine.

No. That would then make us have to assume the type of the server
(which we don't know, and can't negotiate) and risk data corruption.
