Samba always take Apache tcp port !

I forgot to explain that smbd is retstarted by a perl CGI which call /etc/rc.d/init.d/smb stop then
start. When the CGI is called by the web page, lsof -p pid_of_smbd show that smbd open
files owned by httpd, if I call the CGI in a shell it doesn't happend.

I tried to use userv (a tool like sudo) to launch the CGI in the web page and then It seems
to work ok !
