Could be ...
1. An ACL protection on the files which fail. Trying doing a 'dir/acl'
on the culprit files. You will need the 'security' privilege to see acls
which were created with the hidden option.

2. Are the files definitely NOT open at the time of the backup (sh
dev/fil) ?
