duplicate dns zones 4.0.9 and samba-master

About a year ago I reported this bug. 
https://bugzilla.samba.org/show_bug.cgi?id=9210 I have since upgraded 
the domain to win2k8r2 and the same problem still exists. As I noted in 
the bug. This now prevents me from using bind as a dns backend as bind 
sees 2 zones with the same name. I need to know if there is a way to 
remove the duplicate zone?

I think this bug needs to be added as a blocker.

Also DDNS updates are not working, it just gives a TKEY error.
