No, this turned out to be some odd ball acl's set during the upgrade under
/usr/local/samba/var/locks/sysvol  every thing under the sysvol and bellow
with permissions different from that of a fresh provision.  I copied the
sysvol ACL's recursively and that solved the problem.  I had previously
reset the ACL's just on the scripts directory but apparently they must have
to match up the through the parents.

Today I had the DNS stop forwarding on Version 4.1.0pre1-GIT-5bb60df  with
"../source4/smbd/process_single.c:56(single_accept_connection)
  single_accept_connection: accept: NT_STATUS_TOO_MANY_OPENED_FILES" in the
log.  I see that some one else had that same experience about 5 days ago.
I haven't looked at the mentioned but though.
