thanks for your quick answer!
Originally, it was the same system, but meanwhile I have tested the same
using openSUSE 10.3:

suse103:/samba/samba-docs # cat /etc/SuSE-release
openSUSE 10.3 (i586)
VERSION = 10.3

suse103:/samba/samba-docs # make pdf
Generating Samba3-ByExample.tex...
xsltproc --stringparam
letterpaper,11pt,openright,twoside --stringparam latex.imagebasedir
"Samba3-ByExample/" --xinclude --output Samba3-ByExample.tex
xslt/latex.xsl Samba3-ByExample/index.xml
compilation error: file line 366 element
xsl:template: error duplicate name 'question.answer.label'
make: *** [Samba3-ByExample.tex] Error 5

suse103:/samba/samba-docs # xsltproc --version
Using libxml 20630, libxslt 10120 and libexslt 813
xsltproc was compiled against libxml 20630, libxslt 10120 and libexslt 813
libxslt 10120 was compiled against libxml 20630
libexslt 813 was compiled against libxml 20630

IMHO using the same name twice is the problem, not xsltproc.
