Or perhaps even extend the protocol to use some reasonable form of 
encoding of "bad" characters, and have Samba and the CIFS client agree on 
this extenstion transparently managing such file names over CIFS.

If the directory is only accessed by the CIFS client then a mount flag to 
the CIFS client enabling the encoding form would be sufficient, and would 
also allow Windows file servers to be used for storing such UNIX named 
files. The name would obviously look very strange for other clients if at 
all visible.
