No - NT doesn't care if you negotiate them or not - so
long as you send them with the correct bit set NT accepts
them.

In fact, for some error returns you *have* to send NT
error codes or the client screws up.

It's not the only thing NT does wrong. I've found *so many*
NT client bugs in the last round of Samba2 regression testing
it's not funny.
