patch to avoid race condition in rsync 2.5.6

Unfortunately, that patch is too simplistic -- e.g. it doesn't handle
the case where the file had to be copied into place.  I'll try to come
up with a better patch, but I do want to be sure we think though any
repercussions before I commit a change like this.
