Not only that, but they even state what cannot be refunded (via 
http://www.microsoft.com/mscorp/productrefund/refund.mspx )

What Products Are Not Eligible for a Refund?

    * Original Equipment Manufacturer (OEM) software preloaded on a PC 
(contact the PC manufacturer)
    * Original Equipment Manufacturer (OEM) software sold separately 
from PC (contact the reseller or retailer)

So, basically, this will get cyclical, as (for arguments sake), David 
Jones will say "talk to Toshiba", Toshiba will say "you knew when you 
bought it that it had windows on it, so you should have asked for a 
laptop with windows".

You go back to DJ's, who say "we don't provide special orders, you'd 
need to talk to Toshiba about that" and Toshiba will say "We don't do 
special orders below 500 units".
