The legislation I've seen gives express permission for that part of  
the conversation to be recorded, for the purposes of evidence that  
you asked for the rest of the conversation to not be recorded. Check  
the archives for the link in a previous message (only to the NSW  
legislation in 1984 which may or may not correspond to the respective  
ACT legislation).
