Couldn't Open source softare then be treated like free engeneering? for example, take the Adventure playground. It's free for public use, but has a big sign out the front saying that you can use this equipment at your own risk. 

If your kid breaks his neck playing on it, you can't sure whoever the hell the engineer was who designed it. It's the custodian's fault for letting the kid play there in the first place.

Couln't the same sort of thing apply to software?
